Elf Marketing Do’s and Don’ts for Party Professionals

As Christmas approaches, many of us are busy planning festive deliveries — and for many businesses, that includes those adorable little elves!
But before you launch your marketing, it’s important to make sure you’re not accidentally infringing on trademarks such as Elf on the Shelf®.

Here’s what you need to know to keep your Christmas promotions both merry and compliant

DO’s

  • Sell elf toys with your balloon designs.

  • There’s no issue with selling elves — it’s only the marketing language that can cause trouble.

  • Use safe, generic wording.

  • Try phrases like “Christmas Elf Delivery,” “Festive Family Balloon Surprise,” or “Elf Balloon Gift.”

  • Share photos freely.

You can post pictures of your designs — even if they include an elf toy — as long as your captions and hashtags don’t use trademarked names.

Be proactive - If you spot any old marketing materials or posts using “Elf on the Shelf®”, update or remove them. It’s better to act now than risk a warning later.

DON’Ts

  • Don’t use the phrase “Elf on the Shelf” in your advertising - that’s a registered trademark, and using it without permission could breach trademark law.

  • Don’t assume it’s fine because you’ve “always done it.”

  • Enforcement can happen at any time, especially as the brand grows. Small businesses have been caught out in recent years.

  • Don’t copy competitors - they might not know the rules , or they may have permission. Focus on protecting your business.

Don’t risk using other trademarked Christmas names.

Terms like “Grinch,” “Rudolph,” or “The Snowman” are also protected. Use generic alternatives such as “grumpy green character,” “reindeer,” or “classic snowman.”

The Bottom Line

You can absolutely offer Elf balloon deliveries — just keep your wording original and avoid brand names.

It’s a simple step that protects your business, your reputation, and our industry’s professionalism.
